From my understanding, the reason he cannot connect to the server would be the fact that he is attempting to connect to servers during peak hours. As such, it won't waste a space for someone under the amnesty program. He's able to connect,  just not during these times.

I don't see being nice is enough to justify a bending of the rule with a specific case. It sets a precedent that others could believe would work.
